隨著攝影科技、網路發展一日千里,素人性私密影像拍攝製作、色情簡訊傳送開始蔚為風潮,非經同意散布性私密影像—俗稱復仇式色情—也躋身成為新興侵害隱私、造成被害人與社會嚴重傷害之行為類型。立法者面對瞬息萬變的科技進步及難以掌握的新興隱私侵害行為,應如何應對、管制,著實需要審慎思考。我國現行法是否足以管制經同意散布性私密影像行為,且被害人能夠藉此尋求救濟,顯然為一大問題。經本文討論後,我國法確實有其不足之處,而借鏡美國法規範實務,可發現美國法固然有制定專門管制非經同意散布性私密影像行為之法律規定,然各州及立法主體所制定之規定條文內容參差不齊,部分要件規定(如行為人意圖、造成實際傷害)在操作上顯有不符

現實情況、難以適用之情事。此均可為我國未來單一專門特別法或修法參考之依據。另外,在美國法規範實務中,經常可見系爭管制規定違反憲法所保障之言論自由疑慮。因此,本文將會通盤檢討對非經同意散布性私密影像行為之管制措施在具備何種要件下,才能夠通過違憲審查,並以此結論提供我國立法者未來立法及修法方向與建議,期待立法者將來可以制定既能保護被害人,又能兼顧行為人言論自由之管制非經同意散布性私密影像行為法律規範。
